Arizona AG Brnovich Slams Biden Admin For Fighting Citizenship Requirement For Voting
Arizona Attorney General Mark Brnovich blasted the Biden Administration on a Wednesday Fox News appearance over the Department of Justice (DOJ) bid to block a state law requiring proof of citizenship to vote in presidential elections.
Brnovich, who is running for the GOP nomination for Senate, said states like Arizona must constantly battle federal overreach under Biden, whether it’s over vaccine mandates, COVID relief bills, or the border crisis.
“Now the Biden administration is suing our state just because we have a requirement that if you want to vote in a presidential election or if you want to vote by mail, you have to show proof of citizenship,” he told “Faulkner Focus” host Harris Faulkner.
Brnovich said the move by the DOJ was the “height of absurdity” coming from the Biden Administration.
“The Biden administration has incentivized and decriminalized people coming into this country illegally, and now they don’t want Arizona to check for citizenship,” Brnovich said. “You don’t need to be a rocket scientist or even an astronaut to figure out what’s going on here with the Biden administration.”
On Tuesday, the DOJ announced it’s suing the State of Arizona over a law Governor Doug Ducey signed earlier this year which the feds called “redundant and unconstitutional.”
Authorities said the law “turns the clock back on progress by imposing unlawful and unnecessary requirements that would block eligible voters from the registration rolls for certain federal elections.”
Ducey said the bill brings a balanced approach that honors the state’s voting accessibility history without sacrificing election security.
“Federal law prohibits non-citizens from voting in federal elections,” Ducey said in a letter. “Arizona law prohibits non-citizens from voting for all state and local offices and requires proof of citizenship.”
But DOJ officials also said the bill constitutes a textbook violation of the National Voter Registration Act, which requires Arizona to “accept and use” a completed and valid Federal Form to register qualified applicants to vote in all elections for federal office. While the form does not require documented proof of citizenship, it does ask under penalty of perjury whether or not one is a citizen.
Ducey’s office said during the 2020 presidential election, approximately 11,600 federal-only voters in Arizona cast a ballot without having to show proof of citizenship.
Arizona used to require proof of citizenship to vote in federal elections. Still, the Supreme Court struck down the law 10 years ago, holding that it violated the National Voter Registration Act.
But Brnovich and other state officials are fighting back.
Shortly after the DOJ announced its latest lawsuit against Arizona, Brnovich said he’s ready to go toe-to-toe with the Biden administration in court.
“It’s another round of Brnovich v. Biden as his DOJ continues its attempts to undermine our election integrity laws,” he said in a tweet. “I will see you in court.
“Again,” he added.
