Illegal Immigrant Deported Four Times Who Allegedly Killed Mom, Son In Drunk Driving Crash Has Bond Set

 Bond has been set for an illegal immigrant who has been deported four times and is accused of killing a mother and son in a drunk driving crash.

Jose Guadalupe Menjivar-Alas’ bond was set at $250,000 cash only by a Colorado judge on Thursday, Fox News reported.

Menjivar-Alas, 37, appeared in court virtually from the Broomfield County Jail near Denver on Thursday.

Menjivar-Alas is a citizen of El Salvador and has been deported from the U.S. four times, Immigration and Customs Enforcement (ICE) told Fox News.

“ICE records show that the subject has been previously removed and has no regard for immigration law,” an ICE spokesman told the outlet.

The judge cited community safety concerns, as well as concerns about whether he would show up to court if released.

“Just even the possibility that Mr. Menijvar would be deported if he posts bond is very concerning,” the judge said during the hearing.

Menjivar-Alas was arrested on December 15 in connection with a fatal crash three days prior on Main Street in Broomfield.

He drove a Toyota Tundra into a Mazda CX-5, killing the two people inside, Melissa Powell, 47, and her son Riordan, 16. Police said they believe alcohol and speeding were contributing factors to the fatal crash.

He was booked at the Broomfield County Jail and charged with a DUI, vehicular homicide from reckless driving, and vehicular homicide caused by DUI after he was released from a hospital following the crash. He was also designated a habitual traffic offender.

Before his arrest last month, Menjivar-Alas already had several previous Driving While Intoxicated (DWI) convictions.

Menjivar-Alas was first deported in 2009, but he entered the U.S. again. He was removed again in 2013, 2014, and 2015.

Prior to his first deportation, he was convicted of a DWI and driving with alcohol in 2007 when he was around 20 years old. He later got DWI convictions again in 2016 and 2019.

 

At the time of the crash, Menjivar-Alas was actually waiting for a jail bed for yet another alcohol-related driving conviction, The Denver Post reported.

He had been sentenced just four days prior after pleading guilty to a DWI, a DUI, and a harassment charge, the outlet reported.

Prosecutors had pushed for him to get a year in jail, but the judge in that case sentenced him only to work release and probation and allowed him to go free while he waited for a spot in jail, court records show.

Over the course of that case, Menjivar-Alas failed to show up to court multiple times, which caused the court case to be dragged out over seven years.

ICE’s Denver office lodged an immigration detainer with Broomfield County on December 18, three days after his arrest, ICE said, accordingto Fox News.
