The Biden regime is letting the people responsible for orchestrating 9/11 escape true justice.

The New York Post reported this morning that a military appeals court Monday night ruled against Defense Secretary Austin’s order this summer wiping out plea deals reached with 9/11 mastermind Khalid Sheikh Mohammad, Walid bin Attash, and Mustafa al-Hawsawi. The three-judge panel upheld a lower court ruling that Austin’s order came too late and he had no authority to issue it.

“We agree with the military judge that the secretary did not have authority to revoke respondents’ existing PTAs because the respondents had started performance of the PTAs,” the panel said.

Mohammad and his cronies are expected to plead guilty in a court hearing next week. The New York Post notes that while Austin can appeal the decision, it is unclear whether he will.

The terrorists’ defense attorneys successfully argued Austin lacked the authority to overturn the sweetheart agreement because the top authority of the Guantanamo Bay courts had already approved it.

They also stated that Austin’s order was unconstitutional.

As The Gateway Pundit previously reported, three September 11 masterminds reached plea deals with the US government to spare them the death penalty while they were awaiting trial in Guantanamo Bay, Cuba. They agreed to plead guilty to war crimes as part of their agreement.

As the Post notes, the agreements were signed by Pentagon official Susan K. Escallier, whom Austin appointed to be in charge of military commissions.

Austin, though, pulled the deal after the Biden regime came under mounting pressure from various political factions and advocacy groups who argued that any leniency shown to those involved in the 9/11 attacks undermines justice for the nearly 3,000 victims and their families.

“I have determined that, in light of the significance of the decision to enter into pre-trial agreements with the accused in the above-referenced case, responsibility for such a decision should rest with me as the superior convening authority under the Military Commissions Act of 2009,” Austin wrote in an order.

“Effective immediately, I hereby withdraw your authority in the above-referenced case to enter into a pre-trial agreement and reserve such authority to myself. Effective immediately, in the exercise of my authority, I hereby withdraw from the three pre-trial agreements that you signed on July 31, 2024, in the above-referenced case,” he added.

But his efforts came too late, and now American taxpayers will pay the price.
